Affiliate Agreement

By filling out the signup form you acknowledge that you have read the terms and conditions, understand, and agree with them.

1. Terms of Agreement
   These terms will begin upon your signup with the affiliate program and will end when your affiliate account is terminated. The terms of this agreement may be modified by us at any time. If any modification to the terms is unnacceptable to you, your only choice is to terminate your affiliate account. Your continuing participation in the program will constitute your acceptance of any change.

 

2. Joining The Program.
   By filling out the Affiliate Agreement form you will automatically be considered an affiliate and are bound by the terms of this agreement. Your participation in the program is solely for this purpose: to legally advertise our website to receive a commission on products purchased by your referrals.

    

3. Revocation of Affiliate Status
   Your affiliate application and status in the program may be suspended or terminated for any of the following reasons:
   
   
   1. Inappropriate advertisements (False claims, misleading hyperlinks)
   2. Spamming (mass email, mass newsgroup posting, etc...)
   3. Advertising on sites containing/promoting illegal activities
   4. Violation of intellectual property rights.

   We reserve the right to revoke an individuals Affiliate status for any reason.

    

4. Affiliate Links
   You may use graphic and text links both on your website and in emails. The site may also be advertised "offline" in classified ads, magazines, and newpapers. You may use the graphics and text provided to you by us, or you may create your own as long as they are deemed appropriate according to the conditions in 3.

 

5. Commision Periods
   Commision periods are from the 1st to the 15th of the month and from the 16th to the end of the month. All commisions are paid one period after the commision has been earned.

   Example:
   A customer you referred signs up on the 10th of April. The commision would be paid on the 1st of May.

   Example:
   A customer you reffered signs up on the 23rd of April. The commision would be paid on the 16th of May.

 

6. Commision Terms
   Contractors Mark shall compensate each Affiliate in accordance with Contractors Mark's then current commission schedule for sale of a website by a referred visitor to the Affiliate. The currrent commision is $50 per website.
   
   
   1. The referral must have completed payment, with no chargebacks.
   2. Your Affiliate account must be fully registered and approved by Contractors Mark through completion of this agreement in order to be paid.
   3. Affiliates can not earn commission on the purchase of their own account and/or purchases made on their own billing account.
   4. Commissions earned through our Affiliate program can not be transferred to another user or transferred to any other other program.

   By filling out this form you acknowledge that you have read the terms and conditions, understand, and agree with them.

 

7. Modification
   We may modify any terms and conditions contained in this Agreement at any time and at our sole discretion by posting a change notice or a new agreement on our site. Modifications may include for example, changes in the scope of available commissions, commission schedules, payment procedures, and Program rules.

   IF ANY MODIFICATION IS UNACCEPTABLE TO THE AFFILIATE, AFFILIATE'S RECOURSE IS TO TERMINATE THIS AGREEMENT. THE CONTINUED PARTICIPATION OF AFFILIATES IN THE PROGRAM, FOLLOWING OUR POSTING OF A CHANGE NOTICE OR NEW AGREEMENT ON OUR SITE WILL CONSTITUTE BINDING ACCEPTANCE OF THE CHANGE.

 

8. Taxes
   You are responsible for the payment of all taxes related to the commissions you earn under this Agreement. In compliance with tax laws, Contractors Mark will issue a Form 1099 to Affiliates whose earnings meet or exceed the applicable amount warranting the Form 1099.

 

9. Independent Contractor
   The parties hereto are independent contractors acting for their own accounts; may not bind, act for or represent the other; and have no agency, partnership or joint venture relationship.

 

10. Limitation of Liability
    WE WILL NOT BE LIABLE FOR INDIRECT, SPECIAL, INCIDENTAL, OR CONSEQUENTIAL DAMAGES, OR ANY LOSS OF REVENUE, PROFITS, OR DATA, ARISING IN CONNECTION WITH THIS AGREEMENT OR THE AFFILIATE PROGRAM, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. FURTHER, OUR AGGREGATE LIABILITY ARISING WITH RESPECT TO THIS AGREEMENT AND THE AFFILIATE PROGRAM WILL NOT EXCEED THE TOTAL COMMISSIONS PAID OR PAYABLE TO YOU UNDER THIS AGREEMENT.

 

11. Miscellaneous
    This Agreement is governed by the laws of the United States and the State of Texas, without reference to rules governing choice of laws. Any action relating to this Agreement must be brought in a Federal or State court located in Fort Worth, Texas, and the Affiliate irrevocably consents to its jurisdiction. No Affiliate may assign this Agreement, by operation of law or otherwise, without our prior written consent. Our failure to enforce Affiliates' strict performance of any provision of this Agreement will not constitute a waiver of our right to subsequently enforce that provision, or any other provision of this Agreement. THE AFFILIATE ACKNOWLEDGES THAT HE HAS READ THIS AGREEMENT AND AGREES TO ALL ITS TERMS AND CONDITIONS.
